Privacy Policy

  • Fen Photography  takes your privacy very seriously. This privacy policy  dated the 23rd May 2018 has been prepared in line with the EU’s General Data Protection Regulation (GDPR), which promotes fairness and transparency for all individuals in respect of their personal data. This privacy policy applies to all data we process, and by using Fen Photography you consent to our collection and use of such data.   As a data controller we collect a variety of data in order to deliver our services, and we will manage your personal data transparently, fairly and securely. We may ask you to provide us the following data First and Last Name / Address / Postcode, Telephone Number(s) / Email . To meet the new GDPR Fen Photography will also record a date of birth for all persons we photograph under the age of 13 and require the parent or a legal guardian to consent to photography. Obviously being a photographic business we also create and manage images as per our contractual agreement(s).  This will include using images for marketing purposes for Fen Photography, These images will be in agreement with the privacy policy and a contractural agreement will have been signed.   We also share your personal data (images) with the following third parties: Google  (analytical)  Gmail , Facebook and Instagram,  Website manager , Photographic Gallery) .   We may transfer personal data to a country outside of the European Economic Area (EEA) if necessary eg if a third party we utilise could have servers located outside of the EEA. If this is the case, we will either obtain your consent or otherwise ensure that the transfer is legal and your data is secure by following the EU's guidelines.  The third parties we use have all developed the systems with  policy in place to enable them to meet the EU Guidleines for GDPR.  Fen Photography uses a payment machine managed by Barclaycard  This Data is not transferred outside of the European Economic Area and Barclaycard is fully compliant with GDPR.  
  •  We may change this privacy policy from time to time 
  • Fen Photography will do this by changing the date on this policy, notifying customers of only significant changes. By continuing to access or use our services after those changes become effective, you agree to be bound by the revised privacy policy.  While we do not hold personal data any longer than we need to. The duration will depend on your relationship with us, and whether it is ongoing. We may keep some of your personal data for After this time we will archive your photographs indefinitely along with your relevant details and consent forms. This is due to requests for replacement images being made several years after being taken.  If you wish your data in the format of digital images are not to be kept you for a period of time  this can be requested, however for the purpose of tax records your personal data i.e as a customer may be stored for up to 7 years.

Terms and Conditions



All rights reserved The conditions apply to all orders by Fen Photography. No variation of terms and conditions set out herein shall be effective unless agreed in writing by both parties. Terms and conditions are subject to change without prior notice. All images on Fen Photography.co.uk are owned by the photographer Frances Nethersole and must not be copied, printed or used in any other way without prior written consent from the photographer. The 1988 Copyright Act assigns the copyright of any photographs taken by the Photographer Frances Nethersole and  it is therefore contrary to the Act, and illegal, to copy photographs, or allow to be copied, by any means photographic or otherwise by any person or machine other than by The Photographer It is understood that the copyright of all the photographs belong to Fen Photography and may be used to promote Fen photography. The Client on signing a model release form hereby allows Frances Nethersole The Photographer to display any photograph and to generally promote the business in advertising, brochures, magazine articles, websites and other such material, providing that the images used are used lawfully and without damage to The Client(s).


No photographs purchased may be copied or reproduced by any means photographic or otherwise by any person or machine other than the photographer, unless a USB memory stick of the images has been purchased, or digital images have been provided to you and  you have been given a signed licence to print document. Any  client that has done this may use these images  on the internet /social media but the photographer should be made aware of this as courtesy and Fenphotography.co.uk should be credited on or near the photograph. As in accordance with The Copyright, Designs and Patents Act 1988  Fen Photography has the right to be identified as the author of the work. There may be exceptions to this if it has been agreed with the photographer.No liability shall be held by Frances Nethersole  for any photographic work undertaken.


Session fees must be paid before the clients attend and all sessions are strictly by appointment only. A  non refundable session fee secures your booking,  Rescheduling appointments however will be considered individually for example if a new born arrives later than expected. Fen Photography may consider refunding your deposit if cancelled more than 28 days prior to your booked session.  No photographs will be printed /provided without payment received in advance. Any printing of images from USB or digital downloads will be in Jpeg and suitable for printing to a size specified. Fen photography will not be responsible for the quality of any images printed as all printing sources have different calibrations. 


Fen Photography restricts the use of mobile phones for taking photos during a session. Prices do not include courier, post and packaging costs. Additional charges for edits will be incurred for example tattoo removal, or removing/moving items such as headbands.
